These Terms of Use ("Terms") govern your access to and use of the Outakes mobile app, website, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.
Your account
You must provide accurate information, keep your account credentials secure, and promptly notify us of unauthorized use. You are responsible for activity occurring through your account. You may not impersonate another person or create an account for someone else without authorization.
Your content
You retain ownership of photos, videos, text, doodles, comments, and other content you submit to Outakes ("User Content"). You grant Outakes a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify solely for technical formatting, display, and distribute your User Content as needed to operate and improve the Services. This license ends when your content is deleted, except where copies must remain for a limited time in backups, legal records, or content shared by others.
You represent that you have the rights needed to submit User Content and that your content and conduct do not violate law, another person's rights, or these Terms.
Acceptable use
You may not use Outakes to:
- harass, threaten, exploit, or harm another person;
- post unlawful, abusive, hateful, sexually exploitative, or privacy-invasive content;
- share content that infringes intellectual property or other rights;
- spam, mislead, impersonate, or engage in fraud;
- access accounts or systems without authorization, distribute malware, scrape the Services, or interfere with their operation; or
- use the Services for an unlawful purpose.
Safety and moderation
We may review, restrict, remove, or preserve content and may limit or suspend accounts when reasonably necessary to enforce these Terms, protect users, comply with law, or maintain the Services. You can use in-app reporting tools where available or contact us about safety concerns.
Our Services
Outakes and its software, branding, design, and other materials are owned by us or our licensors and are protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services. We may add, change, suspend, or discontinue features and do not guarantee that every feature will always be available.
Termination
You may stop using Outakes or delete your account at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or misuse the Services. Provisions that by their nature should survive termination will remain in effect.
Disclaimers and limitation of liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation or the accuracy of user content. To the fullest extent permitted by law, Outakes will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Nothing in these Terms limits rights or liability that cannot legally be limited.
Privacy
Our Privacy Policy explains how we collect, use, and handle information and is incorporated into these Terms.
Changes to these Terms
We may update these Terms from time to time. We will post the revised Terms here and update the effective date. Your continued use after revised Terms take effect means you accept them, except where applicable law requires another form of consent.
